The Small Claims Court in Ontario adjudicates claims related to monetary compensation or personal property with a value not exceeding $35,000, exclusive of interest or costs.
Within the jurisdiction of Ontario's Small Claims Court, cases involving monetary claims arising from various agreements are heard, encompassing unpaid accounts for goods or services, outstanding rent, and loans. Additionally, the court entertains claims for damages, including instances of property damage, personal injuries, and breaches of contract.
The monetary threshold of CAD $35,000 encompasses both the pecuniary sum and the overall value of properties declared by the plaintiff. It is noteworthy that while claims exceeding CAD $35,000 can still be filed in the Small Claims Court, any amount surpassing this limit must be relinquished. For instance, filing two distinct cases to circumvent this threshold is not permissible. In the scenario where the claimed amount is $40,000, it is not admissible to file one claim for $35,000 and initiate a subsequent claim for the remaining $5,000.
The Small Claims Court accommodates lawsuits for money owed pursuant to agreements, encompassing goods or services sold and delivered for which payment has not been received, unsettled loans, outstanding rent, and non-sufficient funds (NSF) cheques.
Furthermore, the court allows lawsuits for damages, including property damage, clothing damaged by a dry cleaner, personal injuries, and breach of contract.
